We thank you for using eSave. Please read the present conditions carefully. By accessing to and using eSave, you agree to be bound by the conditions of use. The impressum and disclaimer of the website www.macsonline.de shall also apply (www.macsonline.de/_en/contact/imprint.html). MACS reserves the right to unilaterally change the conditions of use. Users will be timely notified.

2.1 Authorized use

The use of eSave is restricted to authorized users only. You are an authorized user if you have received a username and password by MACS or one of its authorized representatives. If you are not an authorized user please contact the MACS eSave Administration support immediately (esavesupport@macsonline.de). Unauthorized use will be prosecuted under criminal and civil law. You are not allowed to use eSave other than for business purposes and the purposes for which it was designed. You are not allowed to make eSave available to third parties, to copy eSave or parts of it, to leave eSave to anyone for a period of time, particularly not to rent or to lend eSave. You agree to make the data of customers anonymous while using eSave. If your role in eSave is announced as an eSave Resource (Account) Manager, you assume the responsibility for updating the list of eSave accounts in your Financial Institution, which includes periodical review of all accounts, checking if there are users who are not within the Institution any more, blocking and unblocking accounts (for any valid reason) and requesting from MACS eSave Administration support (esavesupport@macsonline.de) any changes in the access levels of existing accounts, as well requests for deleting existing and/or adding new accounts.

2.2 Liability

The calculation results are estimates derived from simplified models and should not be regarded as completely accurate. Methodological assumptions and simplifications have been applied in accordance with recognized engineering principles. This approach yields results with an accuracy level suitable for estimating greenhouse gas and primary energy savings in loan eligibility assessments based on defined minimum thresholds. You are responsible for the content and accuracy of data entered into eSave. MACS will remain free from any third party claims resulting from such content. You agree that MACS will not be liable for any direct or indirect damages arising out of or in connection with the use of eSave or a linked site, or with the delay or inability to use the website. This site may contain links to other World Wide Web sites (Third Party Sites). MACS is not responsible for the availability or content of Third Party Sites. Neither can MACS accept any liability or give any guarantee for those websites.

2.3 Copyright and ownership

MACS owns all necessary rights, title and interest in and to eSave. The content, structure and design of the eSave website is protected by copyright. Texts, text portions, graphs, tables or illustrative material, their contents and copies may not in any way be altered, reproduced and distributed or transmitted to third parties without the prior written consent of MACS.

2.4 Settlement of disputes

These Conditions shall be governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply. Any disputes under or in connection with the use of eSave or this website shall first be brought to mediation (Mediation). The right of the Parties to interim actions (einstweiliger Rechtsschutz) and later legal actions shall remain unaffected hereof.

2.5 Final provisions

If any provision of these Conditions should be or become invalid or unenforceable, the validity and enforceability of the remainder of these Conditions shall remain unaffected thereby.
